1. About these terms

These Terms & Conditions (“Terms”) govern your use of the Unleashed Canine Academy mobile application and related services (the “App”), operated by Unleashed Canine Academy Pty Ltd (“Unleashed”, “we”, “us”, or “our”), based in Gold Coast, Queensland, Australia.

By activating an account, signing in, or otherwise using the App, you agree to these Terms. If you do not agree, please do not use the App.

These Terms govern your use of the App only. Your broader relationship with Unleashed is governed separately by Unleashed’s Business Terms & Conditions, as in effect from time to time. By using the App, you acknowledge that your service relationship with Unleashed remains subject to those Business Terms & Conditions. Where there is a conflict between the two in relation to your use of the App, these Terms prevail.

2. The service

The App provides dog-training content and tools, including training videos shared with you by your trainer, the ability to submit your own “homework” videos for review, per-video discussion with your trainer, and tools to manage your dog’s profile, skills, and training progress.

The App is provided as part of a training relationship with Unleashed and is intended for use by current clients.

3. Your account

• Accounts are created by Unleashed and activated by you using an invitation code.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• You must provide accurate information and keep it up to date.
• You must be at least 18 years old to use the App.

4. Our content — training videos

All training videos, materials, text, and other content made available to you through the App are the intellectual property of Unleashed (or its licensors) and are protected by copyright and other laws.

The training content is licensed to you for your personal, non-commercial use only, solely to support the training of your own dog. You must not:

• download, record, screen-capture, copy, or store the training videos outside the App;
• share, redistribute, republish, sell, or otherwise make the training content available to any third party;
• use the training content for any commercial purpose.

Your access to training content lasts only while you are a client and while access is granted, and may be revoked at any time.

5. Content you submit — homework videos

When you submit a homework video or other content (“Your Content”) through the App, you retain ownership of it. However, by submitting Your Content, you grant Unleashed a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, edit, adapt, and publish Your Content for the purposes of:

• providing the training service and reviewing your progress; and
• promotional, educational, and marketing purposes, including on social media (for example, Instagram), websites, and other channels.

By submitting Your Content, you confirm and warrant that:

• you own Your Content or have all necessary rights to submit it and grant this licence;
• you have the consent of any person who appears or is identifiable in Your Content (including their voice or likeness) to its use as described above; and
• Your Content does not infringe the rights of any third party.

We will not publish Your Content in a way that is misleading, and we will respect any reasonable request to stop using previously published content going forward, although we cannot recall material already distributed.

You agree to indemnify Unleashed against any loss, claim, or expense arising from a breach of the warranties in this section. You also consent to Unleashed using, editing, and adapting Your Content in ways that may otherwise affect moral rights, to the extent permitted by law.

6. Acceptable use

You agree not to misuse the App, including by attempting to gain unauthorised access, interfering with its operation, uploading unlawful or offensive content, or using it in breach of any applicable law.

We may remove, restrict access to, or refuse to publish any content that breaches this section.

7. Availability

The App is provided on an “as is” and “as available” basis. We do not guarantee that it will always be available, uninterrupted, or error-free, and we may modify, suspend, or discontinue features at any time.

8. Training disclaimer

Training content and guidance provided through the App are general in nature and do not guarantee any particular outcome or behavioural result. Dog training, including the exercises and techniques described in the App’s training content, carries inherent risks, including risk of injury to your dog, to other animals, or to people, particularly where exercises are practised without a trainer directly present. You are solely responsible for assessing whether a particular exercise is appropriate for your dog’s individual temperament, health, and circumstances at the time, and for the safe and supervised handling of your dog at all times. To the maximum extent permitted by law, Unleashed is not liable for any injury, loss, or damage to you, your dog, any other animal, or any other person, arising from your use or application of the training content.

9. Limitation of liability

To the maximum extent permitted by law, Unleashed will not be liable for any indirect, incidental, or consequential loss arising from your use of the App. Nothing in these Terms excludes any rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Termination

We may suspend or terminate your access to the App at any time, including if you breach these Terms or cease to be a client. You may stop using the App at any time.

On termination, your access to the App and its content will end; the licence granted under Section 5 in respect of content already submitted continues.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date shows the latest version. Your continued use of the App after changes take effect means you accept the updated Terms.

12. General

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. These Terms constitute the entire agreement between you and Unleashed in relation to the App. You may not assign or transfer your rights under these Terms; Unleashed may assign or transfer these Terms in connection with a transfer of its business.

13. Governing law

These Terms are governed by the laws of the State of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
